Terms of Service (CatchMe)

TL;DR

  • CatchMe is a real-world physical outdoor game — you play at your own risk; mind traffic, surroundings, and your own limits.

  • By joining a lobby you knowingly agree to share your live GPS location with the other players for the duration of the match.

  • The app does not use traditional account login; your identity is a player ID stored on your device.

  • In-app purchases are processed by Apple and Google; refunds must be requested from them.

  • Material rule-breaking can get you suspended or banned.

1. Acceptance

By downloading the CatchMe app, creating a player profile, or using the service, you agree to these Terms. If you don't agree, don't use the service.

2. Definitions

  • User / Player — anyone using the CatchMe app.

  • Player profile — the device-stored identity (player ID + name + avatar) that the app and server use to recognise you. There is no traditional account login.

  • Lobby — pre-match staging area where a host invites players and assigns teams.

  • Match — a single timed, area-bounded session of gameplay.

  • Host — the player who created and configures the lobby. The host's entitlement (free or premium) determines which features are available to everyone in the match (see §8).

  • Runner / Catcher — the two core roles (fleeing / chasing).

3. Eligibility / Age

The service is available to users at least 13 years old (or at least 16 where local law requires). Minors may only use it with parent or guardian permission, ideally with adult supervision during matches.

4. Player Profile / Username

You choose your player name. You must not impersonate anyone, use offensive or unlawful names, or hijack someone else's player ID. The host can kick any player from their own lobby and is responsible for moderating their lobby. We may also remove inappropriate names or avatars.

5. Responsible Play and Safety Disclaimer

CatchMe is a physical game played outdoors in the real world. Running and exploring are part of the experience, but you remain responsible for your own safety and your surroundings.

While playing:

  • Don't run into traffic; cross streets sensibly; never run a red light to score a point.

  • Don't trespass on private property or restricted areas (industrial sites, construction, etc.).

  • Stay off rail lines. The app deliberately does not place collectibles on railway tracks, but you remain responsible for your own movement.

  • Don't play while driving, biking, riding a scooter, or operating heavy machinery.

  • Watch your surroundings — pedestrians, cyclists, dogs, vehicles, stairs, holes, water.

  • Take breaks, hydrate, dress for the weather.

  • Minors should play under adult supervision.

CatchMe is not liable for any injury, accident, theft, loss of property, encounter with third parties, trespass, legal violation, or any other harm arising from your decision to play. Players play at their own risk. This includes — without limitation — traffic accidents, encounters with strangers, trespass, weather events, and medical episodes.

6. Location-Sharing Acknowledgment

By joining a lobby, you knowingly and voluntarily consent that the host and every other player in that lobby will receive your real-time GPS location for the duration of the match, per the rules in Section 6 of the Privacy Policy. After the match, the full GPS trace is saved as a replay and available to participants inside the mobile app. You can delete your own match replays at any time from your in-app match history (this also removes the position trace from our servers); see Privacy Policy §3.4 for details.

  • Only join lobbies with people you know and trust.

  • We provide the platform; we cannot vet who is on the other side of an invitation.

  • Playing with strangers is not recommended — especially for minors.

  • If at any time you feel unsafe, leave the lobby. The host cannot prevent you from leaving the match.

7. Prohibited Conduct

You must not:

  • use GPS spoofing or any location-faking tool in real lobbies,

  • harass, threaten, or send hate speech via chat,

  • share other players' personal data or dox them,

  • exploit bugs, run automated bots, reverse-engineer the app, or access the API in unauthorized ways,

  • engage in anything illegal in or through the service.

8. In-App Purchases (Apple App Store + Google Play)

  • All payments are processed by Apple or Google. We do not see or store your card data. The applicable Apple Media Services / EULA and Google Play Terms also apply. RevenueCat handles receipt validation on our side.

  • How free vs premium works in CatchMe. Whether a match runs in free or premium mode is determined by the host's current entitlement at match start — not by each guest individually:

    • If the host holds a valid premium entitlement (24-hour Pass active, or Lifetime), the match runs in premium mode: all premium features are available to every player in that match, host and guests alike, with no purchase required from the guests.

    • If the host is a free user, the match runs in free mode: a smaller set of collectibles is available, and the play area is fixed for the entire match (the host cannot configure multi-phase areas that change over the course of the game).

    • Team slots are unlimited in both modes. The difference between free and premium is the available game features, not the size of the lobby or the number of teams.

  • Current offerings:

    • Free tier — no purchase needed. You can host or join matches in free mode as described above.

    • 24-hour Pass — one-time consumable purchase that grants the buyer a premium entitlement for 24 hours from activation. While the entitlement is active, every match the buyer hosts runs in premium mode (and every guest in that match enjoys premium features for the duration of the match). Does not auto-renew; if you want another 24-hour window, you have to buy a new pass.

    • Lifetime — one-time purchase that grants the buyer a permanent premium entitlement on their player profile. Every match the buyer hosts always runs in premium mode.

  • No subscriptions, no auto-renewing products. CatchMe currently does not sell any recurring subscription — you are never charged on a recurring basis.

  • Refunds are governed exclusively by Apple's and Google's policies and must be requested directly from them.

  • EU 14-day right of withdrawal: Under the EU Consumer Rights Directive, the 14-day withdrawal right does not apply to digital content/services where performance has begun at your express request and you have acknowledged that you thereby lose your right of withdrawal. By completing the purchase, you expressly consent to immediate performance of the digital service (you can play right away) and acknowledge the loss of the 14-day withdrawal right.

  • Lifetime purchases survive future ownership changes per Apple/Google rules.

  • Restoring purchases in-app is supported via Apple ID / Google Play (relevant for the Lifetime purchase; the 24-hour Pass is a consumable and does not restore once it has expired).

  • Prices are shown in HUF/EUR/USD as displayed by the store.

  • Currently only IAP is supported; no external / web-based payments. If this changes in the future, we will update these Terms.

9. Service Availability / No Warranty

CatchMe is provided "as is" on a best-effort basis. We do not guarantee an SLA, error-free operation, or uninterrupted availability; downtime can occur for maintenance, fixes, or third-party (Apple/Google/network) outages.

10. Intellectual Property

The CatchMe app, brand, graphics, codebase, and content are owned by us or our licensors. You retain ownership of your user-generated content (chat messages, profile photo) but grant us a non-exclusive, royalty-free license necessary to display and operate that content within the game.

11. UGC Moderation

We reserve the right to remove any chat message, name, or profile photo, and to warn, kick, suspend, or terminate users who break the rules.

12. Termination & Self-Service Data Removal

For serious or repeated violations we may suspend or terminate your player profile (server-side block on your player ID) without prior notice.

You can also wipe your data yourself, directly in the app:

  • "Delete all my data" in the in-app menu removes every replay you can still delete from your device, unregisters this device from push notifications, clears all locally stored data, and reloads the app as if freshly installed.

  • Match History lets you remove individual replays one by one.

  • For older data no longer reachable through the in-app path (e.g. matches from before the in-app delete feature, or after a reinstall), write to [email protected]. See Privacy Policy §12 for the full procedure and identification rules.

13. Limitation of Liability

To the maximum extent permitted by law, we exclude liability for indirect, consequential, or incidental damages (including lost profits). Our total aggregate liability to you will never exceed the amount you actually paid us through IAP in the 12 months preceding the claim. Some jurisdictions (notably mandatory consumer-law rules) do not allow certain exclusions or caps — there, those clauses do not apply, and mandatory statutory consumer protections remain unaffected.

14. Indemnification

You agree to indemnify and hold harmless Burcz Alex E.V. against any claim, cost, or damages (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the service, or your violation of third-party rights.

15. Changes

For material changes we will notify you inside the app. Continued use after the effective date counts as acceptance.

16. Governing Law and Jurisdiction

These Terms are governed by Hungarian law. Disputes fall under the courts of Hungary. EU consumers retain the right to bring claims in their member state of residence under the mandatory rules of consumer protection law.

17. Dispute Resolution

Please first contact us at [email protected] — most issues are resolved that way. EU consumers may also turn to the conciliation board (békéltető testület) competent for their residence; for the controller's seat in Hungary (Győr-Moson-Sopron county) this is the Győr-Moson-Sopron Vármegyei Békéltető Testület.
